Good news for trans youth: Federal judge blocks Indiana ban on gender-affirming healthcare

We interrupt our regular, er, depressing crap for some rare good news on the trans front. From The Independent:

A federal judge in Indiana has partially blocked a ban on affirming healthcare for transgender youth, continuing a streak of victories in legal challenges against state laws targeting gender-affirming care.

The ruling on 16 June from US District Judge James Patrick Hanlon, who was appointed by Donald Trump, issues a preliminary injunction against the recently enacted law.

His ruling is the fourth recent courtroom victory for trans youth and LGBT+ advocates who have challenged similar laws across the US, including a recent federal court ruling in Florida that eviscerated the state’s anti-trans policies and condemned the bigotry that fuelled such legislation.

In addition to the rulings in Indiana and Florida, we’ve seen victories in Tennessee, where a judge blocked the state’s draconian anti-drag legislation; and in West Virginia, where the Supreme Court upheld a lower court injunction against a law banning transgender women and girls from participating on public-school sports teams as women and girls.

There will be more of these victories to come as these unjust and blatantly unconstitutional bills make their way through the courts.

According to the Human Rights Campaign, more than 500 bills targeting LGBTQ+ folks have been introduced into state legislatures this year, with 220 bills aimed at trans and nonbinary people. 60 of these anti-LGBTQ+ bills have already been signed into law. HRC has taken the unprecedented step of declaring a State of Emergency for LGBTQ+ people. But this anti-trans, anti-gay offensive isn’t popular outside of MAGA-land. And LGBTQ+ folks and their allies are pushing back.

At least there’s some good news on this front, it seems like the whole thing has been relentless. I hope there’s more victories for the LGBTQ+ community soon, there needs to be pushback against the nonsense to put it lightly.

In some of those states, I wouldn’t be surprised if from the judge’s perspective it might be ‘Even if I agree with the basic principle behind this law, it is so broadly and badly written that it will inevitably become a shitshow, and I don’t want that shitshow traveling through my courtroom.’

You know what’s crazy. These anti trans laws don’t stop the nonconsensual surgeries on intersex babies genitals.

Of course not. Non-consensual operations on intersex children are all about maintaining the illusion of ‘normality’ to society at large. Completely consensual transition operations are all about what is best for that person, to hell with ‘normality’.

It also shows yet another case in which those who scream the loudest about ‘individuality’ do a complete 180 when it’s somebody else’s individuality that makes them uncomfortable. Then it’s perfectly okay to get the government to force the situation.

Since these laws are almost all completely unmodified “model legislation” being copied over and over they can be expected to fall like dominos now a few have been tipped.

As someone who works in healthcare, I continue to be appalled at how many random members of the public think they should weigh in on patient care when:

  • They are not the patient
  • They are not the patient’s parent/guardian
  • They are not the patient’s insurance company (‘cos those bastards meddle in healthcare ALL THE TIME)
  • They are not the patient’s doctor or nurse or other member of the patient’s medical team
  • They are not a doctor or nurse or anybody else directly involved in patient care of any kind

‘Cos it’s a ridiculous invasion of privacy that they themselves would not put up with – witness how many of them also whinged about wearing masks during a fucking pandemic.

I’d apologize for the f-bomb, but cases are rising and we’re hearing more and more scary stuff about long COVID, and I’m bloody sick and tired of ignorance.

Or to cover up a circumcising surgeon’s oopsie—as happened in the case of David Reimer (https://en.wikipedia.org/wiki/David_Reimer) And the fact that he had an identical twin who recovered from the same urogenital condition without surgical intervention leads me to wonder if someone was conducting a Mengelesque experiment.)

This was one they were worried about as the judge is very conservative. But I do find that generally judges take their role very seriously and act conscientiously.
